These Terms of Service (“Terms”) govern your purchase and use of Foxiz Next, the edition of the Foxiz theme and Foxiz Core plugin sold through this store, which is operated by ThemeRuby (“we”, “us”, or “our”). Foxiz is available in two editions: Foxiz Next, sold here on renewal-based plans, and Foxiz Classic, a one-time purchase on ThemeForest. These Terms govern Foxiz Next together with your use of this store and the services we provide here. Foxiz Classic is licensed under Envato’s terms, which govern that purchase; these Terms apply to Foxiz Classic only where you use this store or those services. By completing a purchase, creating an account, or using Foxiz, you agree to these Terms. If you do not agree, please do not purchase or use the products. Please also read our Privacy Policy, Refund Policy, and License & Renewal policy, which form part of these Terms.
1. Agreement and eligibility
To purchase Foxiz you must be able to form a legally binding contract in your jurisdiction. When you create an account, you agree to provide accurate information, to keep your login credentials secure, and to be responsible for all activity that takes place under your account. Please keep your contact details up to date so we can reach you about your license, renewals, and important notices.
2. License grant
When you purchase Foxiz Next, we grant you a limited, non-exclusive, non-transferable, and revocable license to install and use the theme and the Foxiz Core plugin on the number of production sites included in your plan. You may customize Foxiz for your own projects or for websites you build for clients. Local and staging environments do not count toward your site limit. Moving a license between sites is a courtesy we provide on top of these terms; a license detected running on more live sites at the same time than your plan allows may be temporarily suspended pending review. This license continues while your plan is active, as described in our License & Renewal policy. Foxiz Classic, purchased on ThemeForest, is licensed to you under the applicable Envato license, which is typically the Regular License for use on a single site.
3. Ownership and intellectual property
Foxiz, including its source code, design, demo content, documentation, logos, and trademarks, is owned by ThemeRuby and its licensors and is protected by intellectual-property laws. Except for the license expressly granted to you in these Terms, no rights are transferred to you. Some components distributed with Foxiz may be provided under their own open-source licenses (such as the GNU General Public License); where that is the case, those licenses govern those specific components. You retain all rights to the content, media, and data you add to your own websites.
4. Acceptable use and restrictions
You agree not to: redistribute, resell, sublicense, lease, or share your license key or the Foxiz files with any third party; include Foxiz in a “theme pack”, template marketplace, or any product that competes with it; reverse-engineer, decompile, or attempt to circumvent the licensing system or your plan’s site limits; remove or alter any copyright, trademark, or license notices; or use Foxiz for unlawful, infringing, or harmful content. You must also comply with the terms of WordPress, Freemius, Envato, and any applicable law. You are solely responsible for the content and operation of the websites where Foxiz is installed.
5. Payments, taxes, and pricing
Payments in this store are processed securely by our licensing and payments partner, Freemius. Prices and any applicable taxes are shown at checkout, and you are responsible for any taxes, duties, or bank charges that apply to your purchase. By buying an annual plan, you authorize recurring charges to your chosen payment method until you cancel. We may change our prices from time to time; any change takes effect for future purchases and for renewals that occur after we have given you reasonable notice, and it never affects an order you have already paid for.
6. Auto-renewal and cancellation
These renewal terms apply to Foxiz Next. Annual plans renew automatically at the end of each term until you cancel, so that your updates and support do not lapse. You can cancel at any time from your Freemius account; cancellation stops future renewals and takes effect at the end of the current paid term, and your site keeps working. One-time lifetime plans are billed once and do not auto-renew. Foxiz Classic is a one-time purchase on ThemeForest and does not renew.

Foxiz Next purchases in this store are covered by our 14-day money-back guarantee. See the Refund Policy for full details and conditions. Purchases of Foxiz Classic made on ThemeForest are governed by Envato’s terms and refund rules rather than this policy.
8. Chargebacks and payment disputes
If you believe you were charged in error, please contact us first at [email protected] so we can resolve it quickly, usually faster than a bank dispute. Filing a chargeback or payment dispute without contacting us, or where a valid refund has already been offered, may lead us to suspend or terminate the associated license, and we reserve the right to recover amounts owed and reasonable costs.
9. Updates, support, and lifetime plans
Foxiz Next includes automatic updates and premium support while your license is active, as described in our License & Renewal policy, and it is the edition where new features are released first. Foxiz Classic continues to receive security, compatibility, and maintenance updates so that existing sites stay stable and secure. Lifetime plans on Foxiz Next are a one-time payment that includes updates and support which never renew. As is standard in our industry, “lifetime” refers to the lifetime of the product, not the lifetime of the purchaser, and it is not a perpetual or personal guarantee: updates and support are provided for as long as we continue to actively sell and maintain the product. We may discontinue the sale, development, or support of any product, plan, or edition at any time; when a product reaches the end of its life, updates and support for it end. Because lifetime plans are one-time payments, they are not eligible for pro-rated or partial refunds if the product is later discontinued. We do not guarantee that any particular feature will be maintained indefinitely, and we may add, change, or discontinue features over time.
10. Third-party services
Foxiz and this store rely on third-party services, including Freemius (checkout, payments, and license management), Envato/ThemeForest (for purchases made there), WordPress, and providers such as web-font and hosting services. Your use of those services is subject to their own terms and privacy policies, and we are not responsible for them. Our Privacy Policy explains what data these providers handle on our behalf.
11. Disclaimer of warranties
Foxiz is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Foxiz will be uninterrupted, error-free, secure, or compatible with every hosting environment, plugin, or third-party service, or that it will meet your specific requirements. You are responsible for maintaining backups of your websites.
12. Limitation of liability
To the maximum extent permitted by law, ThemeRuby and its team are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of, or inability to use, Foxiz. Our total aggregate liability for any claim relating to Foxiz or these Terms will not exceed the amount you paid us for the product in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless ThemeRuby and its team from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising from your misuse of Foxiz, the content or operation of your websites, or your breach of these Terms or of any applicable law or third-party rights.
14. Suspension and termination
We may suspend or terminate your license if you materially breach these Terms, use Foxiz unlawfully, or abuse the licensing system. If your license is terminated for breach, the rights granted to you end and you must stop using and, where required, remove the Foxiz files. Provisions that by their nature should survive termination, such as ownership, disclaimers, limitation of liability, and indemnification, will continue to apply.
15. Changes to these Terms
We may update these Terms from time to time. The current version is always posted on this page with its “last updated” date, and continued use of Foxiz after an update means you accept the revised Terms. If a change is significant, we will make reasonable efforts to notify you.
16. Governing law and disputes
These Terms are governed by and construed in accordance with the laws applicable in the jurisdiction in which ThemeRuby is established, without regard to its conflict-of-law rules. If a dispute arises, you agree to first contact us so we can try to resolve it informally. Any dispute that cannot be resolved this way will be handled by the competent courts of that jurisdiction. Nothing in these Terms limits any mandatory consumer-protection rights you may have under the laws of your country of residence.
17. General
If any provision of these Terms is found to be unenforceable, the remaining provisions will stay in full force and effect. Our failure to enforce a right is not a waiver of that right. You may not assign or transfer these Terms without our consent; we may assign them to a successor, for example as part of a merger or sale of the business. These Terms, together with the policies they reference, are the entire agreement between you and us regarding Foxiz and this store.
